1. About the program
1.1 Program name and sender. "Mother Earth Labs Texts" is our text-message program. Our texts identify us as "Mother Earth Labs."
1.2 How these SMS Terms fit with our other terms. These SMS Terms are part of our Terms of Service. Our Privacy Policy explains how we handle your information. If these SMS Terms conflict with our Terms of Service, these SMS Terms control for our texts. Sections 21 and 22 of our Terms of Service always control for disputes (Section 12).
2. Texts you may receive
2.1 Marketing texts. If you sign up for marketing texts, we'll send you recurring automated marketing texts. These may include offers and discounts, new product announcements, reminders about items left in your cart, restock alerts and other promotions.
2.2 Order texts. If you sign up for order updates by text, we'll send you automated texts about your orders, shipping and delivery, subscription renewals and changes, and your account. If you have signed up for order texts, we may also text you about a safety notice or recall for a product you bought. Order texts are not marketing.
2.3 Separate sign-ups. Marketing texts and order texts each need their own sign-up. Signing up for one doesn't sign you up for the other.
3. Your consent
3.1 How you sign up. We don't offer sign-up yet. When we do, we'll offer it only in ways that clearly ask for your consent, such as a sign-up form on our website, a checkbox at checkout or a keyword you text to the program number we publish. We may text you to ask you to confirm your sign-up.
3.2 What you agree to. By signing up for marketing texts, you agree to receive recurring automated marketing texts from Mother Earth Labs at the mobile number you provide. You also agree to these SMS Terms. Our texts may be sent using automated technology.
3.3 Not a condition of purchase. You don't have to agree to receive marketing texts to buy anything from us.
3.4 Your number. You confirm that you are the account holder for the mobile number you provide, or that you regularly use it with the account holder's permission. Don't sign up anyone else's number. If you change or give up your number, reply STOP from that number first or tell us, so that we don't text the number's next owner.
4. How often we text
Message frequency varies. The number of texts depends on our promotions, your activity (such as items left in your cart) and your orders. We follow state laws that limit how many marketing texts may be sent in a day.
5. Costs
We don't charge for our texts, but message and data rates may apply. What you pay depends on your mobile plan. Contact your wireless carrier with any questions about your plan.
6. Help
Reply HELP to any of our texts for help. You can also contact us at (210) 408-2800 (Monday–Friday, 9 AM–5 PM Central Time, excluding US federal holidays) or at customersupport@motherearthlabs.com.
7. How to stop texts
7.1 Reply STOP. You can cancel at any time. Reply STOP to any text from us. You can also reply STOP ALL, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE or OPT OUT.
7.2 Other ways to opt out. You can also tell us that you want to stop in any other reasonable way. For example, you can call or email us, use an opt-out link we provide, or reply with words that reasonably show you want to stop, such as "Please stop texting me."
7.3 When it takes effect. We'll process a STOP reply right away, and any other request promptly. We'll honor every opt-out request within 10 business days at most. We may send one text confirming your request. That text won't contain marketing.
7.4 What STOP covers. Replying STOP to any of our texts stops all marketing texts from us. If you also get order texts from us, replying STOP also stops those texts, unless you tell us you want to keep getting them. Our confirmation text may tell you how to keep them.
7.5 Rejoining. To get texts again, reply START or UNSTOP, or sign up again.
8. When we text
We send marketing texts only between 8 AM and 9 PM in your local time, and within any narrower hours or days that the law where you live requires. We estimate your local time from your area code or address. If we have it wrong, please tell us. Order texts about an order or delivery you're expecting may be sent at other times.
9. Who can join
You must be at least 18 years old, or the age of majority where you live if that is higher, to sign up. Once it starts, the program will be available for US mobile numbers. We'll text Canadian mobile numbers only if we offer the program in Canada and you give the consent that Canadian law requires. Our texts will be available on major US wireless carriers. The program may not be available on every carrier or device.
10. Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Texts may also be delayed or not delivered for reasons outside our control, such as poor coverage or a problem with your device. Don't rely on our texts for time-sensitive information.
11. Privacy
11.1 Privacy Policy. Our Privacy Policy explains how we collect, use and share personal information, including your mobile number and how you interact with our texts.
11.2 We don't share your mobile opt-in data for others' marketing. We will not sell or share the mobile number you give us for our texts, or your text-message opt-in data and consent, with third parties or affiliates for their marketing or promotional purposes. We share this information only with the service providers that help us run our texts, such as our text-messaging platform and wireless carriers. We never add mobile numbers from our text program to advertising audiences. This section doesn't cover a phone number you give us at checkout or in your account, which our Privacy Policy covers. Our advertising tools may send that number to Meta and Google in hashed (scrambled) form, with other contact details such as your email address, name or address (Section 6.2 of our Privacy Policy).
11.3 Health information. Please don't text us details about your health or medical conditions. To report a reaction to one of our products, call or email us as Section 6.6 of our Terms of Service explains. If you do text us about a reaction, we'll treat your text as a report and may contact you to follow up. Our Privacy Policy explains how we handle health-related information. If you live in Washington or Nevada, our Consumer Health Data Privacy Policy also applies.
11.4 Records. We keep records of your consent, your opt-out requests and our texts to you while you're signed up and for 5 years after, to show that we followed the law.
12. Disputes
Québec: Section 22.2 of our Terms of Service (courts), referred to in the next sentence, does not apply to consumers in Québec.
Sections 21 (dispute resolution and arbitration for US customers) and 22 (governing law and courts) of our Terms of Service apply to any dispute about our texts or these SMS Terms, as if they were written here.
If you live in the United States and Section 21 of our Terms of Service applies to you (Section 1.4 of those Terms explains when it does), Section 21 requires most disputes to be resolved by binding individual arbitration. You and we each give up the right to a jury trial and to take part in a class action. You can opt out of arbitration within 30 days, as Section 21.11 explains. Section 21 does not apply if you live outside the United States.
13. Changes and ending the program
We may change these SMS Terms or end the program at any time. We'll post changes on this page with a new "Last updated" date. For a significant change, we'll also tell subscribers by text or email before it takes effect. We won't use a change to start sending you a type of text you haven't agreed to receive. If you don't agree to a change, reply STOP.
