This policy explains how High Coast Capital L.L.C., doing business as Mother Earth Labs USA ("Mother Earth Labs," "we," "us" or "our"), handles consumer health data. It covers Washington's My Health My Data Act (RCW 19.373) and Nevada's consumer health data law (Senate Bill 370 of 2023). It is effective on the date shown above.
1. Who this policy applies to
This policy applies to you if you live in Washington or Nevada, or if your consumer health data is collected in Washington or Nevada.
"Consumer health data" means personal information that is linked or reasonably linkable to you and that identifies your past, present or future physical or mental health status. It can include information inferred from other data.
2. Consumer health data we collect, where it comes from and how we use it
| Category | Examples | Sources | How we use it |
|---|---|---|---|
| Purchase information that may reveal a health goal | Products you buy or subscribe to whose name or purpose relates to a health goal (for example, sleep, digestion or bone support) | You, when you shop | To fill and ship orders, run subscriptions, handle refunds, returns and warranty claims, provide customer support and keep required records. Also to decide which emails and offers to send you, and to measure and show our ads (Section 3). We don't ask for separate consent for these last uses (Section 4). |
| Browsing information that may reveal a health goal | Such products that you view or add to your cart on our website | Your device, through cookies and similar tools | To show you pages and keep your cart, to analyze how our website is used, to remind you about a checkout you didn't finish, and to measure and show our ads (Section 3). Our tools record this information when a page loads, before you make any cookie choice (Section 4). |
| Product quiz answers | Your goals and any health-related answers you give in a product quiz, if we offer one, and your results | You | To give you product recommendations. With your consent, to personalize our emails. |
| Health interests | Interests you select when signing up for emails, such as "Performance & Recovery," "Rest" or "Gut Health" | You | To decide which emails to send you. Our sign-up pop-up asks you to choose one before you can sign up (Section 4). |
| Health information in messages | Health details you include in chats, emails, calls, refund requests or other messages to us | You | To answer your question or request and keep records of our support. |
| Side-effect and reaction reports | Information about a side effect or reaction, and related health details, that you or a store that sold you the product reports to us | You; stores that sell our products | To investigate it, follow up with you, keep our products safe, report to the US Food and Drug Administration when the law requires and keep the records the law requires. |
| Reviews that mention health | Health statements in reviews you submit | You | To moderate and publish reviews, and to follow up on reviews that report a side effect or reaction. |
| Inferences | Conclusions drawn from the information above, such as a likely interest in sleep or digestion products | Our own analysis and our processors' analysis | To decide which emails and offers to send you. |
We also use consumer health data, where needed, to prevent fraud, protect the security of our services, respond to your requests under this policy, comply with the law and establish, exercise or defend legal claims.
3. Consumer health data we share and who receives it
3.1 Processors. We disclose consumer health data to these service providers, which handle it for us. Most of them do so under contracts, such as their standard terms or data processing agreements, that limit how they can use it. Gorgias, which runs our AI support assistant, says its AI also learns from support conversations across the businesses that use it (Privacy Policy, Section 14.6). Each provider receives the categories in Section 2 that its service involves. They provide:
- our online store and checkout: Shopify;
- subscriptions: Appstle;
- shipping: ShipStation, Intuitive Shipping, Shipping Rates & Rules and carriers;
- returns: Loop Returns;
- accounting and business systems: NetSuite, QuickBooks Online;
- email and texts: Klaviyo;
- chat and customer support: Gorgias (including our AI support assistant, which may answer chats and support emails first; its email replies say so at the start and end, and in chat its messages may be marked as automated) and our phone provider;
- reviews: Judge.me;
- rewards: Smile.io;
- affiliate programs: UpPromote, and Impact.com once our ambassador program on it launches;
- bundles and back-in-stock alerts: Kaching Bundles, STOQ;
- our product quiz: RevenueHunt;
- analytics: Google Analytics;
- ad measurement for the advertising partners in Section 3.2: Parkour;
- AI tools that help our team analyze store and support information: Anthropic (Claude), through connectors to our store, help-desk, email-marketing and payment accounts;
- advertising: our agency, Marketing360, including its tracking pixel on our website;
- email, phone and cloud storage: our IT and communications providers; and
- professional advice: our professional advisers.
3.2 Third parties. We share consumer health data with these categories of third parties:
| Third party | Consumer health data they receive | Why |
|---|---|---|
| Government agencies, such as the US Food and Drug Administration | Side-effect and reaction reports and related purchase information | When the law requires a report, or in response to valid legal process |
| The store that sold you the product | Details of your reaction report or complaint | To investigate it or carry out a recall |
| The public | Review content you choose to post, with the name or display name you choose | Because you chose to publish it |
| PayPal, if you choose to pay with PayPal | Order details, which may include the names of products you buy | To process your payment |
| Referral partners and friends who referred you, through our referral platforms | Depending on the platform and its settings, the names of products in an order they referred | To credit and reward them |
| A buyer or successor of our business | The categories needed to continue serving you | A merger, acquisition or sale of all or part of our business |
| Advertising partners (Google and Meta, TikTok when we run campaigns there, and any other ad networks our agency, Marketing360, uses for our campaigns) | Purchase and browsing information that may reveal a health goal, such as the names and IDs of products you view, add to your cart or buy. They receive it when a page loads, before you make any cookie choice, and we don't ask for your separate consent first (Section 4) | To measure and show our ads. They may also use it for their own purposes, such as improving their ad services, under their own privacy policies |
We never give advertising partners quiz answers, health interests, messages, reaction reports or review content.
3.3 Affiliates. We don't share consumer health data with any affiliate. High Coast Capital L.L.C. also does business as Terra Pure Labs USA. That brand is part of the same company, not a separate one. Some staff and systems, such as order fulfillment, serve both brands, and they handle your consumer health data only to run Mother Earth Labs orders and our business as this policy describes.
3.4 Third parties that collect information on our website. Advertising partners may collect information about your activity over time and across different websites and online services, including ours, through cookies and similar tools.
4. Your consent
4.1 When we ask. We collect and use consumer health data as needed to provide a product or service you ask for. For example, we need your purchase information to ship your order. Currently, we don't ask for your separate consent before these other uses:
- Interests you choose when signing up for emails. Our sign-up pop-up asks you to choose an interest, such as "Rest" or "Gut Health," before you can sign up and get our WELCOME10 code. We use the interest you choose to decide which emails to send you.
- Products you view and buy. When a page on our website loads, our analytics, email and advertising tools record the products you view and add to your cart. Advertising partners receive this information, and information about the products you buy, before you make any cookie choice (Section 3.2). We also use your purchase information to decide which emails and offers to send you.
If you take a product quiz, we ask for your consent before using your answers to personalize our emails. Section 4.3 explains how to stop the uses above.
4.2 How we ask. Before we ask for consent, we tell you which consumer health data is involved, why we want it, who will receive it and how to withdraw your consent. You give consent by a clear action, such as checking a box or selecting an option. Accepting our Terms of Service, closing a notice or continuing to browse is never consent.
4.3 Withdrawing consent and stopping these uses. You can withdraw any consent you've given, or ask us to stop collecting and sharing your consumer health data, at any time by contacting us (Section 6.2). When you do, we delete the interests you chose from your email profile, stop using your browsing and purchase information to decide which emails and offers to send you, and stop including your email address in any customer list we give advertising partners. You can also unsubscribe from our emails at any time. Choosing "Decline" in our cookie banner, where it's shown, turns off the tools connected to it on that browser. But some tags on our website may keep sending the products you view to advertising partners until you block them in your browser settings (Privacy Policy, Section 5.4).
4.4 New uses. We won't collect, use or share consumer health data in new categories, for new purposes or with new third parties or affiliates until we update this policy and get your consent.
5. Sale of consumer health data
We don't sell consumer health data for money. Advertising partners that receive purchase and browsing information through our website (Section 3.2) may also use it for their own purposes under their own privacy policies.
6. Your rights
6.1 What you can ask for. You have the right to:
- confirm and access: confirm whether we collect, share or sell your consumer health data, and get a copy of it;
- see who received it: get a list of all third parties and affiliates with which we've shared or sold your consumer health data, with an active email address or other online way to contact each of them;
- withdraw consent: withdraw your consent to our collection and sharing of your consumer health data;
- stop collection and sharing: ask us to stop collecting and sharing your consumer health data;
- delete: ask us to delete your consumer health data; and
- appeal: appeal our decision about your request.
6.2 How to make a request. You or your authorized agent can make a request by:
- emailing customersupport@motherearthlabs.com with the subject line "Consumer Health Data Request";
- calling (210) 408-2800, Monday–Friday, 9 AM–5 PM Central Time, excluding US federal holidays; or
- writing to High Coast Capital L.L.C., Attn: Privacy Officer, 24210 Scenic Loop Road, San Antonio, Texas 78255, USA.
Our AI support assistant may reply to these emails first, including appeals (Section 6.6). It can't handle requests under this policy. Our team handles every request sent to this address, even if the assistant has replied. Asking for a team member in your message helps it reach a person sooner.
6.3 Verifying your request. We need to authenticate your request before we act on it. We'll usually ask you to confirm information we already have, such as your email address and a recent order number. We may also send a code to your email address. If we can't authenticate your request using commercially reasonable efforts, we'll tell you and may ask for more information. We use that information only to process your request.
6.4 Timing and cost. We respond without undue delay and within 45 days after we receive your request. If we need more time, we may extend this once by up to 45 more days, and we'll tell you why within the first 45 days. Requests are free up to twice a year. If requests are clearly unfounded, excessive or repetitive, we may charge a reasonable fee or decline them, and we'll explain why.
6.5 Deletion. When we delete your consumer health data, we delete it from our records, including archived and backup systems. We also notify all processors, affiliates and third parties that received it and ask them to delete it. We delete it from our active systems within 30 days after we authenticate your request, and from backup systems within 6 months. We may keep information the law requires us to keep, such as records of side-effect reports.
6.6 Appeals. If we decline your request, in whole or in part, you can appeal. Reply to our decision, or email customersupport@motherearthlabs.com with the subject line "Consumer Health Data Appeal." Within 45 days after we receive your appeal, we'll tell you in writing what we did or didn't do, and why. If we deny your appeal, you can complain to your state attorney general:
- Washington: Office of the Attorney General complaint form
- Nevada: Office of the Attorney General complaint form
6.7 No discrimination. We won't treat you differently because you used these rights.
7. Reviewing and changing your consumer health data (Nevada)
You can review your consumer health data and ask us to correct it by contacting us as described in Section 6.2.
8. Changes to this policy
If we make a material change to this policy, we'll post the new version on this page with a new "Last updated" date. We'll also tell you in advance by email (if we have your address) or by a notice on our website. We'll ask for your consent before any change described in Section 4.4.
