These Rewards Program Terms ("Program Terms") explain how our rewards program (the "Program") works. "Mother Earth Labs," "we," "us" and "our" mean High Coast Capital L.L.C., doing business as Mother Earth Labs USA. The rewards panel on our website (the "Rewards page") shows how many points you earn, the rewards you can choose and any other current details. The Rewards page is part of these Program Terms.
At a glance
- Joining is free. You earn points on eligible purchases and for other actions shown on the Rewards page.
- You redeem points for discount codes and other rewards shown on the Rewards page.
- Points and rewards have no cash value and can't be transferred.
- We may remove points earned on products we refund or cancel, whether or not you sent them back.
- Points never expire just because time passes. If points expire after a period with no activity, we won't hold you to an expiration sooner than 12 months with no activity or without at least 30 days' email warning: contact us and we'll restore those points (Section 8).
- Reward codes you get with points don't expire. If one ever stops working, contact us and we'll replace it.
- We'll give you at least 30 days' notice before we make a change that reduces your benefits or end the Program. In Québec, we give 60 to 90 days' notice of any change to the Program or of its end (Section 9.5).
1. About the Program
1.1 Who runs it. We run the Program. Our service provider, Smile.io, provides the technology for the rewards panel and keeps track of points.
1.2 Not a contest. The Program isn't a contest or sweepstakes, and no reward depends on chance. If we run a contest or sweepstakes, it will have its own official rules.
Québec: Sections 21 and 22.2 of our Terms, which Section 1.3 refers to, do not apply to consumers in Québec. Section 23.3 of our Terms explains your rights.
1.3 How these Program Terms fit with our other terms. These Program Terms are part of our Terms of Service. If they conflict with our Terms of Service, these Program Terms control for the Program, except that Sections 21, 22 and 23 of our Terms always apply as Section 1.3 of those Terms explains.
2. Who can join
2.1 Eligibility. You can join if you:
- are at least 18 years old, or the age of majority where you live if that is higher (in New Zealand, 18);
- have a customer account with us; and
- live in a country we ship to (Section 3 of our Shipping Policy).
2.2 One membership per person. Each person may have only one Program membership and one customer account.
2.3 Not included. Wholesale, private-label and other business accounts can't join, and orders placed through them don't qualify for points. If points are added for one of those orders, we may remove them.
Québec: the cancellation of unredeemed points in Section 2.4 does not apply to a consumer in Québec who leaves the Program to refuse a change. Section 9.5 applies instead.
2.4 Joining and leaving. Create a customer account, or log in, and join through the Rewards page. You can leave the Program at any time by contacting us. If you leave, or close your account, any unredeemed points are canceled, except as Section 9.5 explains, so please redeem them first. Reward codes you already have keep working.
3. Earning points
3.1 Purchases. You earn points on eligible purchases at the rate shown on the Rewards page. Unless the Rewards page says otherwise, points are based on the amount you pay for products after discounts, not on taxes, shipping, tips or gift cards.
3.2 Other ways to earn. The Rewards page may offer points for other actions, such as creating an account. You earn those points only as the Rewards page describes.
3.3 Reviews. If we offer points for writing a product review, you get the same points whether your review is positive or negative. Reviews on our website don't currently show whether the reviewer earned points or another reward (Section 11.6 of our Terms). Points are never available for fake reviews or for reviews of products you haven't used.
3.4 When points appear. Points appear in your account when the Rewards page says they do, for example when your order is paid or when it ships. Some points may show as "pending" until then.
3.5 Missing points. If you think points are missing, contact us within 90 days after the purchase or action. We'll check and add any points you're owed.
4. Redeeming points
4.1 Rewards. You can redeem points for the rewards shown on the Rewards page, such as a discount code. The Rewards page shows how many points each reward needs.
4.2 How reward codes work. Unless the reward says otherwise, a reward code:
- can be used once, on one order placed on our website;
- can't be combined with other discount codes;
- can't be used on taxes, shipping (unless it is a free-shipping reward) or gift cards, or on past orders; and
- works on subscription orders only if the reward says so.
If your order is worth less than the reward, the unused value isn't refunded or saved.
4.3 Minimum order and exclusions. Some rewards may need a minimum order amount or may not apply to certain products. The reward shows these limits before you redeem it.
4.4 Reward codes don't expire. A reward code you get by redeeming points doesn't expire. If one ever shows an expiration date or stops working, contact us and we'll replace it. A bonus reward we give you without using your points, such as a birthday or referral reward, may have an expiration date. If it expires sooner than 30 days after we give it to you, or without showing you the date, contact us and we'll replace it.
4.5 Promotional rewards, not gift cards. Reward codes are issued for promotional and loyalty purposes. They are not gift cards or gift certificates.
4.6 Redeemed points. Once you redeem points for a reward, you can't change the reward or get the points back, except as Section 7.2 explains.
5. No cash value; no transfers
Points and rewards have no cash value and can't be exchanged for cash, except where the law requires. You can't sell, buy, transfer or combine points or rewards between accounts. Reward codes are for your own orders.
6. Referrals
This section applies only if the Rewards page offers a referral program.
6.1 How referrals work. You can share your personal referral link with friends. If a friend uses it to place a qualifying first order, your friend and you may each get the reward shown on the Rewards page. The Rewards page shows what counts as a qualifying order and when rewards are issued.
6.2 Who counts as a friend. Your friend must be a new customer who is eligible for the Program. You can't refer yourself, including through another account, email address or payment method, or someone who has already bought from us.
6.3 Share responsibly.
- Share your link only with people you know who would want to hear from you. Only give us a friend's email address if they agree.
- Don't send spam or bulk messages, don't text your link to anyone who hasn't asked for it, and don't post your link on coupon or deal websites.
- Don't use paid ads to share your link, and don't use our brand names in ads or search keywords.
- If you share your link publicly, such as on social media, clearly say that you get a reward if people use it. For example: "I get a reward if you use my link."
- Don't say or suggest that any product treats, cures or prevents a disease, and don't make other claims about our products beyond the product information we provide.
6.4 Emails sent through the referral tool. If the Rewards page lets you send a referral invitation by email, our rewards provider sends it for you. Send an invitation only to a friend who has agreed to hear from us, and only once. If you live in the European Union or the United Kingdom, please share your link yourself instead of sending invitations through the Rewards page. Referral rewards aren't available if you or your friend lives in Australia, and we'll remove any that are issued.
6.5 Limits. The Rewards page may set a limit on the number of referral rewards you can earn. If a friend's qualifying order is canceled or fully refunded, we may remove the referral reward from your account (Section 7).
7. Returns, cancellations and adjustments
7.1 Removing points. If we refund or cancel products, whether or not you sent them back, we may remove the points you earned on those products. If you've already redeemed those points, your balance may go below zero until you earn more. We'll never ask you to pay money for a negative balance.
7.2 Restoring redeemed points. If you used a reward on an order and we refund every product in that order, we'll restore the points you redeemed or reissue the reward. If we refund only part of the order, the reward stays used. Section 7.4 of our Refund Policyexplains how discounts affect your refund.
7.3 Mistakes. If we add or remove points by mistake, we'll correct your balance and tell you if the change is significant.
8. When points expire
8.1 No expiration just because time passes. Points don't expire on a set date or simply because time passes.
8.2 Inactivity. Points may expire after a period with no activity on your Program account, if the Rewards page says so. Earning or redeeming any points counts as activity. We won't hold you to an expiration that comes sooner than 12 months in a row with no activity.
8.3 Warning and restoring points. If your points are set to expire for inactivity, our rewards provider may email you before they do. Earning or redeeming points before the expiration date keeps all your points. If your points expired sooner than 12 months in a row with no activity, or without an email warning from us at least 30 days before, contact us and we'll restore them.
9. Changes to the Program and ending it
Québec: the 30-day notice period in Section 9.1 does not apply to consumers in Québec. Section 9.5 applies instead.
9.1 Changes. We may change the Program, including how you earn points, the rewards available and the points needed for a reward. If a change reduces your benefits, we'll tell you by email and on the Rewards page at least 30 days before it takes effect (60 to 90 days in Québec; see Section 9.5). Until then, you can still redeem your points on the current terms.
9.2 Points you've already earned. A change won't reduce the number of points already in your account.
Québec: the 30-day notice period in Section 9.3 does not apply to consumers in Québec. Section 9.5 applies instead.
9.3 Ending the Program. We may end the Program by telling you by email and on the Rewards page at least 30 days before it ends (60 to 90 days in Québec; see Section 9.5). You can redeem your points until the end date. After that, unredeemed points are canceled. Reward codes issued before the end date keep working as Section 4.4 explains.
9.4 Where the law requires more. If the law where you live requires more notice or more protection, we'll follow it.
9.5 Québec. If you live in Québec, we change only the elements listed in Section 9.1: how you earn points, the rewards available and the points needed for a reward. We'll email you notice of a change to the Program, or of its end, at least 60 days and no more than 90 days before it takes effect. The notice will show the old and new terms, the date the change takes effect and your rights. You can redeem your points on the current terms until the change takes effect, and you can refuse the change by leaving the Program, at no cost, up to 30 days after it takes effect. If you leave for this reason, you don't lose your points: for at least 90 days after you leave, you can still redeem your unredeemed points on the terms that applied before the change. Reward codes you get this way don't expire (Section 4.4). We won't make a change that reduces the value of points you've already earned. For example, we won't raise the points needed for a reward by more than the increase in that reward's retail value.
10. Fraud and misuse
We may withhold or remove points or rewards, cancel reward codes or end a membership if we reasonably believe someone has:
- given false information or created more than one account;
- placed fake orders, or asked for refunds or canceled orders to gain points unfairly;
- broken the referral rules in Section 6;
- used bots, scripts or other automated means; or
- otherwise broken these Program Terms or our Terms of Service.
Where reasonable, we'll tell you first and give you a chance to explain. We'll restore any points we removed by mistake.
11. Taxes
Where the law allows, sales tax is calculated on the price after a reward discount. If a reward is a free product, tax may be charged on it where the law requires.
12. Privacy
To run the Program, we and Smile.io process your name, email address, purchase history, points activity and rewards. If you refer friends or earn points for your birthday or social media follows, we also process the referral details, birthday and social media follows you give us. Smile.io acts as our service provider. Our Privacy Policy explains how we handle this information and your choices, including, in its Notice of Financial Incentive, how we value the information related to the Program.
13. Program emails
We or our rewards provider may email you about your points and rewards, and we'll email you notices under Section 9. These emails are part of the Program, not marketing. Apart from a reminder about a checkout you didn't finish (Section 12.2 of our Privacy Policy), we send marketing emails only if you've agreed to receive them, separately from these Program Terms.
14. Legal terms
- Your rights. Nothing in these Program Terms limits rights you have under the law where you live.
- Disputes. Our Terms of Service apply to the Program. If you live in the United States and Section 21 of our Terms (binding individual arbitration, with a class action and jury trial waiver and a 30-day right to opt out) applies to you under Section 1.4 of our Terms, it also applies to disputes about the Program. Section 21 does not apply if you live outside the United States, including in Canada, Québec, the EU, the UK, Australia, New Zealand or Hong Kong. Section 23 of our Terms explains your rights there.
- Québec. If you live in Québec, you benefit from the protections of the Québec Consumer Protection Act. Section 9.5 of these Program Terms applies to you, and Section 23.3 of our Terms lists the parts of our Terms that don't apply to you.
- Changes to these Program Terms. We'll post updates on this page with a new "Last updated" date and give notice of changes as Section 9 explains.
